TERMS AND CONDITIONS FOR VISITS

Alcohol abuse is dangerous for your health. Please drink responsibly. The sale and tasting of alcoholic beverages are prohibited for persons under eighteen years of age.

Article 1 – Identity of the Service Provider

These Terms and Conditions of Sale are offered by Maison Delas Frères, a brand operated by Champagne Deutz SA, a public limited company with share capital of EUR 6,627,726, registered with the Trade and Companies Register of Reims under number 335 681 359, whose registered office is located at 16 rue Jeanson, BP 9, 51160 Aÿ-Champagne, France, VAT number FR80 335 681 359, hereinafter referred to as “Delas”.

Tours and tastings take place at Maison Delas Frères, 40 avenue Jules Nadi, 26600 Tain-l’Hermitage, France.

Article 2 – Purpose and Scope

These Terms and Conditions govern reservations for tours, tastings, events and other wine tourism experiences offered by Delas, hereinafter referred to as the “Services”, whether booked through www.delas.com, via the Vintrail booking platform, directly through Delas teams, or on the basis of a quotation.

The “Customer” means any person booking a Service. Where the Customer acts for purposes related to their professional activity, consumer protection provisions shall apply only under the conditions provided by law.

Group bookings, private events, seminars and bespoke experiences may be subject to a quotation and specific conditions. In the event of any inconsistency, the expressly accepted specific conditions shall prevail.

Article 3 – Description of the Services

The essential characteristics of each Service are presented before booking, including its content, indicative duration, wines offered, language, location, date, time, capacity, price and any applicable restrictions.

Photographs and illustrations are provided for information purposes only and are not contractually binding.

Delas may adjust the order of the tour, the areas visited or the wines served where such adjustments are justified by safety requirements, production constraints, wine availability or the proper conduct of the visit, provided that the nature of the Service is not substantially altered.

Article 4 – Capacity and Booking on Behalf of Others

The Customer declares that they have the legal capacity required to enter into this agreement.

When booking on behalf of several participants, the Customer warrants that they are authorised to act on their behalf and undertakes to communicate these Terms and Conditions, practical information and safety instructions to them.

The Customer is responsible for the accuracy of the information provided, including their identity, email address, telephone number, date, language and number of participants.

Article 5 – Online Booking and Formation of the Contract

The Customer selects the Service, date, time, language and number of participants from the available options.

Before final confirmation, the Customer may review the details of the booking, its total price and correct any errors.

The Customer accepts these Terms and Conditions by ticking a dedicated unchecked box.

Where the booking creates a payment obligation, the confirmation button shall be labelled “Confirm and Pay”.

The booking becomes binding upon validation, acceptance of these Terms and Conditions, payment authorisation where required, and the dispatch of a confirmation email from the booking platform.

An unconfirmed request does not guarantee availability.

Article 6 – Groups and Bespoke Services

Any booking for more than six persons, private tour, seminar, private hire or special event must be submitted to reservation@delas.com.

Delas shall prepare a proposal or quotation specifying the content, date, number of participants, price, payment terms and cancellation conditions.

The booking becomes binding upon written acceptance of the quotation and payment of the deposit or other required payment.

A late reduction in participant numbers may not result in a price reduction where resources have already been committed.

Delas may refuse additional participants or charge them at the applicable rate, subject to capacity limits and safety regulations.

Article 7 – Prices

The prices applicable are those displayed at the time of booking or stated in the accepted quotation. Prices are expressed in euros, inclusive of all taxes. The total price and any additional charges are presented before confirmation of the booking.

Delas may amend its prices for future bookings. Any subsequent price change shall not apply to reservations already confirmed, except in the event of a modification requested by the Customer.

Article 8 – Payment

Depending on the Service and the information displayed, payment shall be made either online at the time of booking or on-site using one of the payment methods accepted by Delas. The applicable payment method is clearly indicated before confirmation.

For online payments, banking data is processed by the payment service provider www.viva.com. Delas does not retain the card security code. Refusal of payment authorisation or any payment incident prevents confirmation of the booking.

Where a card pre-authorisation is used to secure a booking payable on-site, the amount, duration and specific circumstances allowing a charge to be made shall be disclosed before collection.

Article 9 – No Right of Withdrawal for Dated Visits

In accordance with Article L.221-28, paragraph 12 of the French Consumer Code, the right of withdrawal does not apply to leisure activities provided on a specific date or during a specific period.

Consequently, bookings for dated tours or tastings are not subject to the statutory fourteen-day withdrawal period. Customers only benefit from the cancellation and rescheduling rights set out in Article 10.

Article 10 – Cancellation or Modification by the Customer

Any request must be sent to caveau@delas.com, stating the Customer’s name, booking reference, Service and relevant date. Time limits are calculated from the scheduled start time of the Service; receipt of the email by Delas shall be deemed conclusive.

More than seven calendar days before the Service, the Customer may obtain a full refund or reschedule without charge to an available slot.

Between seven days and forty-eight hours before the Service, amounts paid are non-refundable. One free rescheduling may be granted, subject to availability.

Less than forty-eight hours before the Service, or in the event of a no-show, no refund or rescheduling shall be granted and the full price remains payable.

Rescheduling is subject to availability. Any price increase must be paid by the Customer; if the new rate is lower, the original price shall remain applicable unless Delas decides otherwise as a commercial gesture.

Where a refund is approved, it shall, where possible, be made using the original method of payment within a maximum period of fourteen days.

Article 11 – Late Arrival

Customers must arrive at least ten minutes before the confirmed start time.

In the event of late arrival, Delas may shorten the duration of the Service, integrate the Customer into an already-formed group or refuse access if quality standards or safety requirements can no longer be guaranteed. The scheduled end time may not be extended.

A delay of more than fifteen minutes may be treated as a no-show unless Delas agrees otherwise.

Article 12 – Minors and Alcohol Consumption

Alcohol tastings are reserved for persons aged eighteen years and over. Proof of identity may be requested.

Minors may participate in visits provided they are accompanied and remain under the supervision of their legal guardian. No alcoholic beverages shall be served to them.

For safety reasons, children under ten years of age are not permitted in production areas. The tour route may be adapted accordingly.

A non-alcoholic alternative may be offered where included in the booked experience or upon request, subject to availability.

Delas reserves the right to refuse service of alcohol to any person whose condition or behaviour is incompatible with responsible consumption or safety requirements.

Article 13 – Safety and Conduct

Participants must comply with staff instructions, signage, authorised access areas and any protective equipment requirements.

Smoking or vaping in designated prohibited areas, introducing unauthorised alcoholic beverages, handling equipment without permission, or engaging in dangerous, inappropriate or abusive behaviour is prohibited.

Delas may exclude any participant who fails to comply with these rules, without refund, subject to mandatory legal provisions.

Each driver remains solely responsible for complying with drink-driving laws and road safety regulations.

Liability and Damage

  1. a) The Customer shall be liable for any material damage caused by themselves, their guests, service providers, subcontractors or any person participating in the event held within the facilities made available by Delas.
  2. b) Any damage, deterioration, breakage, loss of equipment, furniture, fixtures, decorations or any other property belonging to Delas shall be subject to additional invoicing corresponding to the actual cost of repair or replacement, upon presentation of supporting documentation.
  3. c) Delas reserves the right to invoice any costs incurred in restoring the premises where such costs result from improper use of the facilities provided.
  4. d) The Customer undertakes to respect the premises, equipment and safety instructions communicated by Delas staff throughout the event.
  5. e) Delas shall not be liable for the loss, theft or deterioration of personal belongings, equipment or goods belonging to the Customer or their guests, except in the event of proven fault on the part of Delas.

Article 14 – Animals

For hygiene and safety reasons, pets are not permitted within the estate or production areas.

An outdoor route may be offered where conditions permit.

Guide dogs and assistance dogs are permitted in accordance with applicable regulations, subject to the safety requirements of certain areas.

Article 15 – Accessibility and Special Requirements

Persons with reduced mobility or specific requirements are invited to inform Delas at the time of booking.

Delas provides information regarding accessibility conditions and implements reasonable accommodations where possible.

Where an area is inaccessible for technical or safety reasons, an alternative route shall be proposed whenever reasonably feasible.

Article 16 – Photography and Image Rights

Photographs for personal use are permitted unless otherwise indicated.

Photography may be prohibited in certain areas for reasons of safety, confidentiality, protection of know-how or image rights.

Any commercial or promotional use requires Delas’ prior written consent.

The recording and distribution of images of employees, guides or other participants must respect their image rights.

Article 17 – Modification or Cancellation by Delas

Delas may modify, postpone or cancel a Service where it becomes impossible or unsafe due to force majeure, adverse weather conditions, a technical or health-related incident, unforeseen production constraints, the exceptional unavailability of a speaker or guide, or, where previously announced, insufficient participant numbers.

Delas shall inform the Customer as soon as possible and offer either an equivalent rescheduling or a full refund of amounts paid.

Unless otherwise required by law, ancillary expenses such as transport, accommodation or catering shall not be reimbursed.

Article 18 – Liability

Delas shall be responsible for the proper performance of its obligations in accordance with applicable law.

Its liability shall not be engaged where non-performance results from the Customer, a participant under the Customer’s responsibility, failure to comply with instructions, the unforeseeable and unavoidable act of a third party, or a force majeure event.

Nothing in these Terms shall limit or exclude any right or liability that may not lawfully be limited or excluded.

Article 19 – Force Majeure

In the event of force majeure as defined by Article 1218 of the French Civil Code, the affected obligations shall be suspended.

If the impediment is permanent or renders performance impossible on the agreed date, the contract shall be terminated with respect to the affected Service and the corresponding sums refunded, unless the Customer accepts a rescheduling.

Termination of the contract shall be governed by Articles 1311 and 1311-1 of the French Civil Code.

Article 20 – Personal Data

Data provided by Customers is processed for the purposes of managing bookings, payments, customer relations, safety requirements and claims.

The purposes, legal bases, recipients, retention periods and data subject rights are described in the Personal Data and Cookies Policy available on delas.com.

Personal data collected through the website is processed in accordance with the applicable provisions of the General Data Protection Regulation (GDPR).

Where necessary, such data may be transmitted to booking and payment service providers.

Marketing communications are based, where required, on consent given separately from the acceptance of these Terms and Conditions.

Article 21 – Evidence and Record Retention

Electronic records maintained under reasonable security conditions shall constitute evidence of bookings, payments and communications.

The Customer shall receive confirmation on a durable medium enabling them to retain contractual information.

Electronic contracts with a value equal to or exceeding the applicable legal threshold shall be archived for the statutory retention period and made accessible to the Customer upon request.

The complaint must specify the Customer’s contact details, booking reference, date and subject matter, together with any supporting documents.

Article 23 – Consumer Mediation

Following a prior written complaint that remains unresolved, a consumer Customer may refer the matter free of charge to the consumer mediator to which Champagne Deutz SA has subscribed.

Article 24 – Governing Law and Jurisdiction

These Terms and Conditions and any agreements to which they apply shall be governed by French law.

In the event of translation, the French version shall prevail, subject to any mandatory consumer protection provisions applicable in the consumer’s country of residence.

Failing an amicable settlement or mediation, consumers may bring proceedings before any court having jurisdiction pursuant to the French Code of Civil Procedure and the French Consumer Code.

Article 25 – Amendments and Severability

Delas may amend these Terms and Conditions for future bookings.

The applicable version shall be the one accepted on the date of booking.

Should any provision be held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The failure to enforce any provision on a particular occasion shall not be construed as a waiver of the right to enforce it subsequently.
